While examining the notifications issued by the Government the Committee on Subordinate Legislation of the Fifth Gujarat Legislative Assembly noticed in several cases that the Government had published draft rules in the Official Gazette inviting the objections and suggestions were received by the Government from the Public, the final notification was published in the Official Gazette very late after its previous publication. The Committee felt that when Objections and Suggestions were received from the Public the final notification could have been published in the Official Gazette immediately after or as soon as possible after the period for receiving objections and suggestions was over. The Committee has, therefore, in para 74 of the Seventh Report laid on the Table of the House on the 27th June, 1980 recommended that –

2.      The aforesaid recommendation of the Committee on Subordinate Legislation is a general recommendation concerning all the Departments of the Secretariat and the Departments must be acting on the aforesaid recommendation. Even then it is considered necessary to bring the aforesaid recommendation to the notice of all the Departments. The Departments are, therefore, requested to see that when no objections and suggestions are received from the public on the draft rules, the final rules are published in the Official Gazette immediately and in no circumstances, the final Publication of the rules should be delayed over sixty days.
